Policies & Agreement
   for Purchases made from Astrolabe, Inc.

This Agreement applies to all purchases made at our website at http://Alabe.com or any Astrolabe website, or by mail/phone/fax/email including but not limited to software CDs or downloads, chart services, books, DVDs, CDs, apparel, jewelry, and lecture and workshop fees.

Price, specifications and the terms of offers are subject to change without notice. Astrolabe is not responsible for typographic and/or photographic errors. Any products that Astrolabe resells are accompanied by the original manufacturer's warranty, if such exists. For any product that is returned, the Customer must receive prior authorization from Astrolabe and pay return shipping charges. Astrolabe reserves the right to refuse service to any individual or company.

Product Listings

Astrolabe strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our website. Due to human error and other determinates, however, we cannot guarantee that all of this information is entirely accurate, complete or current, nor can we assume responsibility for any errors. In the event a product listed on our Website is labeled with an incorrect price or description due to some typographical, informational, technical or other error, Astrolabe shall at its sole discretion have the right to refuse and/or cancel any order for said product and will amend, correct and/or remove the inaccurate information.

Promo Codes

Astrolabe sometimes furnishes a Promotional Code that can be used for discounts during checkout on the Website or by phone or by direct mail sales. These Promo Codes may be found many places such as in print and/or online advertisements, brochures, sent via email to our newsletter and/or promotion subscribers, presented on the Astrolabe website or circulated at events and through other means. Examples of the specials offered by entering a Promo Code during checkout include free shipping, volume discounts, free gifts or sale pricing. The provisions for a Promo Code (including an expiration date and any other conditions) will be included on the same page as the code itself. Please note that Promo Codes are not redeemable for cash and you must spend more than the discount price in order for a promotion to be applied. For example, if a Promo Code offered $10.00 off your next purchase, you would need to spend more than $10.00 to redeem your discount.

Orders

When you place an order, you warrant that you are providing Astrolabe with your true identity and legal residence. All software must be registered to a responsible individual. No software can be registered to a company or other organization, or to a fictitious individual.

Please note: Orders for Solar Fire, JigSaw, The Imperial Astrologer, AstroTides or Zone Trekker software will not be accepted for shipment to Australia, or be eligible for shipment by download to customers who reside in Australia.

An order is not binding upon Astrolabe until it is accepted; Astrolabe must receive payment as well as acknowledgement of this binding agreement before it will accept and process an order. Payment for product(s) ordered is due prior to shipment. If an order is refused for any reason, the order will be voided and any payments you have made will be returned or credited to you.

Orders for downloaded software will not be accepted if placed by phone. Purchasing of downloaded software must be ordered at our website, http://alabe.com or at the website of one of our authorized dealers.

When purchasing software updates, please note that providing your software serial number will help to expedite your order. All serial numbers will be cross-checked in our records. If you do not have your serial number, we will look it up upon receipt of your order.

Payment Methods

Please note that we do not accept payment by wire transfer or gift card.

Security

Security is our number one priority. All on-line transactions are sent through our secure server and encrypted with 128-bit technology. Credit card payments made online are processed through a third party provider and no one at Astrolabe has access to your credit card information. Once we receive your information through the internet, only trusted, authorized employees will process the payment to make sure your information is handled with the utmost level of security. Order Processing Times

We endeavor to fulfill orders as quickly as possible. However, orders are not processed on weekends and holidays, and we cannot guarantee same day-shipping. When the items are in stock and there are no problems with payment or other verification, here are the order processing times you should expect:

Shipping is available throughout the world. We use US Postal Service International Express Shipping for all locations. To Canada, Priority shipping is also available. These are the only international shipping options that are available. Astrolabe is not responsible for any customs charges, duties or any other fees imposed on products entering any country in question from the USA.

Shipping times vary from country to country. Please allow at least a week for most destinations. If a local dealer is available in your country, you may save time and international shipping and customs charges by purchasing locally.

Shipping Charges

Your total cost for purchase of any product will include the shipping and handling charges as shown on your Astrolabe invoice.

All shipping is done through the United States Postal Service. Here are the current rates for software shipping as of November 2016:

$11 for Priority Mail within US
$27 for Express Mail within US
$28 for Global Priority to Canada
$44 for International Express to Canada
$35 for Global Priority to all other countries
$65 for International Express to all other countries

Taxes and Duties

All orders shipped within Massachusetts will be charged state sales tax on the price of the products or services, where applicable, excluding shipping and handling.

Our International Shipping and Handling taxes are exclusive of any duty or import taxes that may be levied at the destination by governmental authorities. Astrolabe is not responsible for paying such duty or import taxes.

Order Status

If your order was shipped through the US Postal Service, they will send you an email when your order is shipped. If you need to check further on your order, you may call us at 1-800-843-6682 on regular business days between the hours of 9:30 am and 5:30 pm U.S. Eastern Time.

Order Changes and Cancellations

You may cancel or make a change to your order provided the order has not already been shipped or the download link has not already been sent. To do so, please call 1-800-843-6682 during Astrolabe's hours of operation. For better assistance, please have your order number ready. If you cancel your order you will receive a credit to your credit/debit card for the full amount in approximately 1-3 business days.

We strongly discourage emailing requests for order changes or cancellations. Because of the sheer volume of emails we receive each day, it is unlikely we will receive the message in time to make an adjustment.

Returns and Refunds

Before returning a product, please phone or otherwise contact an Astrolabe representative to request a Returned Merchandise Authorization (RMA) number, and then write this number on the outside of the package when you return it. Astrolabe retains the right to refuse returned packages that do not have an RMA number displayed. You may make returns subject to the conditions described below.

In the case of a returned product, your original shipping fees are non-refundable. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to Astrolabe. In addition, when returning an item, you are responsible for paying for return postage.

Software

Software supplied on a CD may only be returned for refund within 30 days of the invoice date if the packaging (white envelope with printed End User Agreement) is unopened and untampered with.

Downloaded software may not be exchanged or returned for a refund after the email with the download link is sent. Once you have been sent a link, the software is yours, whether you have installed it or not.

Downloading the software or opening the End User Agreement envelope containing the CD signals your assent to the terms of our End User Agreement. (You can view a PDF of the entire End User Agreement by clicking here.) If you ordered the CD and prefer not to honor the terms of the End User Agreement, you may return the unopened End User Agreement envelope for a full refund of the product price exclusive of shipping and handling charges.

Once you have opened the CD envelope or received the download link for the software, you may not return it for a refund or credit. You assume the responsibility for the selection of the program to achieve your intended results, and for the installation, use and results obtained from the program. Please read our catalog or website descriptions carefully, and study samples of the program output on the website. You may also call us at 1-800-843-6682 to ask questions or request sample output.

Before you make a purchase, we strongly advise that you refer to our software compatibility table at http://alabe.com/Compatibility.html to ascertain whether or not a particular software product will run on your computer. You may also call us with any compatibility questions at 1-800-843-6682.

If you bought your software on a CD Astrolabe does warrant the CD or other physical media on which the software is furnished to be free from defects in materials and workmanship under normal use for a period of 90 days from the date of sale as shown by a copy of your invoice. The sole responsibility of Astrolabe is to replace the program CD or other physical media in the case of defects, free of charge.

Chart Services

Chart service orders are not refundable. However, if we have made an error in entering the birth data and/or chart specifications, Astrolabe will correct the error at no further charge to you. If you make an error in relaying the birth data and/or chart specifications to us, you will be charged for our re-doing the calculations or report.

You assume the responsibility for the selection of the chart calculations or report. Please read the catalog or website descriptions carefully, and study samples of the program output on the website. You may also call us at 1-800-843-6682 to ask questions or request sample output.

All calculations and/or interpretations purchased through our chart service department or supplied free of charge at our Website are intended for entertainment only. Astrolabe assumes no liability for any decisions made based on output from our programs, chart report services or free chart services. In no event will Astrolabe be liable to you or any party for any damages, including any lost profits, lost savings or other incidental or consequential damages arising out of the use of the information provided to you in one of our paid or free chart services.

Other Products

DVDs are non-refundable, but if they are defective they may be exchanged within 30 days of the invoice date for a functional version of the same DVD.

T-shirts, books, and any other products may be returned for refund within 30 days of the invoice date provided we receive them back in the condition in which they were sent.

Technical Support

For the products it sells, Astrolabe provides several avenues of technical assistance. You may obtain technical support at any time through FAQs or the Knowledgebase on our website at http://alabe.com/support, by sending an email to support@alabe.com, or by telephoning 508-896-5081 Monday through Friday between the hours of 11 am and 4 pm U.S. Eastern Time. While personal tech support is free, you are responsible for any phone charges your carrier or phone company may impose. Our toll-free sales line is not available for tech support.

Before requesting technical assistance, we strongly suggest that you first consult the program’s documentation, which is usually provided in a PDF document that resides on the CD or is installed with the program so that it appears as a shortcut on your Windows desktop. Even more conveniently, there may be very complete online help accessible through the program's Help menu or by pressing the F1 key. You may also find timely and instructive help and support through our various web services such as FAQs, forums, discussion groups, etc.

General Terms and Conditions

Purchase Agreement

By accepting delivery of any product ordered from Astrolabe ("Astrolabe"), you ("Customer") agree to be bound by the terms and conditions listed in this document.

Warranties

You assume the responsibility for the selection of the program to achieve your intended results, and for the installation, use and results obtained from the program. Astrolabe, Inc. (and/or ACS, Inc. for ACS PC Atlas) does not warrant that the functions contained in the program will meet your requirements or that the operation of the program will be uninterrupted or error free.

However, Astrolabe, Inc. does warrant the electronic media on which the program is furnished to be free from defects in materials and workmanship under normal use for a period of 90 days from the date of sale as shown by a copy of your invoice. The sole responsibility of Astrolabe, Inc. is to replace the electronic media in case it is defective.

All calculations and/or interpretations produced by our programs are intended for research or entertainment only. The author(s) and Astrolabe, Inc. assume no liability for any decisions made based on output from this program.

In no event will Astrolabe, Inc. be liable to you for any damages, including any lost profits, lost savings or other incidental or consequential damages arising out of the use or inability to use this program. This holds even if Astrolabe, Inc. or a dealer has been told of the possibility of such damages. (Some U.S. states or foreign countries do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.)

Privacy

Astrolabe respects your privacy. We will not under any circumstances sell or release your information to anyone except as outlined in our privacy policy at http://alabe.com/privacy.html.

Website Use

You agree to use the Astrolabe website http://alabe.com, and any other Astrolabe websites (hereafter referred to as the "Website") only for purposes that are permitted by this Policy and Agreement and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. You agree that you will not access or attempt to access the Website other than through the interface that is provided by Astrolabe, unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of Astrolabe. You specifically agree not to access or attempt to access the Website, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers. You agree that you will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website). You agree that you will not duplicate, reproduce, copy, sell, trade or resell the Website or content from the Website for any purpose, except that content from individual pages on the Website can be copied on a limited basis for personal use only. You agree that you are solely responsible for any breach of your obligations under this Policy and Agreement and for the consequences (including any loss or damage which Astrolabe may suffer) of any such breach.

All hyperlinks to other websites from Astrolabe are provided as resources to customers looking for additional information and/or professional opinion. Astrolabe does not assume responsibility for the claims and/or representations made on these or any other websites.

Recordings

Astrolabe does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with Astrolabe unless Customer has provided clear and conspicuous notice to Astrolabe and has received prior written consent from Astrolabe.

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Astrolabe and Customer shall be governed by the laws of the State of Massachusetts, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Astrolabe and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Massachusetts, Barnstable County, USA, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Astrolabe that is more than one year after the date of the applicable invoice.

Severability

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Massachusetts law.

Waiver

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement

These terms and conditions, together with Astrolabe's invoice regarding the products ordered by Customer and any software End User Agreement, are the complete and exclusive agreement between Astrolabe and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Astrolabe and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
